Keepers Sport Terms & Conditions
1. About these Terms
Keepers Sport is owned and operated by Today’s Tale Pty Ltd ACN 124 124 198 (“Keepers Sport”, “we”, “our” or “us”).
These Terms & Conditions (“Terms”) apply when you access or use the Keepers Sport website, platform, services and content (“Services”).
By accessing or using Keepers Sport, you agree to these Terms.
We may update these Terms from time to time. If we make material changes, we will publish the updated Terms on our website and, where appropriate, notify registered users.
2. Using Keepers Sport
You may access publicly available parts of Keepers Sport without registering.
Some features may require you to create an account.
When using Keepers Sport, you must:
- provide information that is accurate to the best of your knowledge;
- keep your account details secure;
- use the Services lawfully and appropriately;
- respect the rights of other people; and
- not interfere with the operation or security of the Services.
You are responsible for activity undertaken through your account.
If you create or operate an account on behalf of an organisation, you confirm that you have authority to do so.
3. Sporting History and Information
Keepers Sport provides a place for sporting history, stories, photographs, records and other information to be preserved, shared and connected.
Information appearing on Keepers Sport may be provided by users, clubs, schools, sporting organisations and other contributors or obtained from publicly available records and other legitimate sources.
Historical information is not always complete or accurate. We do not guarantee the accuracy or completeness of all information appearing on Keepers Sport.
If you believe information relating to you is inaccurate, inappropriate or should not be displayed, you may contact us to request that it be reviewed, corrected or removed.
We reserve the right to correct, edit, restrict or remove information or content where we consider it appropriate.
4. Content You Provide
You retain ownership of content that you own and provide to Keepers Sport.
By providing or uploading content, you give Today’s Tale Pty Ltd a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, publish, adapt and use that content for the purposes of operating, promoting, developing and improving Keepers Sport and its Services.
You should only provide content that you reasonably believe you are entitled to provide or share.
You must not knowingly provide content that:
- is materially false or misleading;
- is defamatory, threatening, offensive or unlawful;
- infringes another person's intellectual property or other legal rights;
- contains information that should reasonably remain private; or
- otherwise breaches these Terms or applicable law.
We may review, edit or remove content where we consider it appropriate.
5. Photographs, Stories and Historical Records
Keepers Sport recognises that historical sporting material may contain information about many people and may have been created or collected many years ago.
The inclusion of a person in historical content does not necessarily mean that person uploaded the content or is a registered Keepers Sport user.
Where concerns are raised about historical content, we will consider them reasonably and may correct, restrict or remove material where appropriate.
6. Intellectual Property
Except for content owned by users or third parties, Today’s Tale Pty Ltd owns or is licensed to use the intellectual property associated with Keepers Sport, including its technology, design, branding, software and original content.
You may use Keepers Sport for its intended purposes but may not reproduce, commercially exploit or distribute our intellectual property without our permission.
Nothing in these Terms transfers ownership of intellectual property to you.
7. Automated Access and Scraping
You must not use automated systems to scrape, crawl, extract, copy or systematically collect information or content from Keepers Sport without our written permission.
This does not prevent recognised search engines from indexing publicly available pages for legitimate search purposes.
You must not attempt to reverse engineer, interfere with or gain unauthorised access to Keepers Sport, its technology or systems.
8. Unacceptable Use
You must not use Keepers Sport:
- for unlawful or fraudulent purposes;
- to impersonate another person;
- to harass, threaten or harm another person;
- to publish defamatory, obscene or unlawful material;
- to distribute spam, malicious software or harmful code;
- to interfere with the Services or other users;
- to infringe another person's rights; or
- in any way that could reasonably damage Keepers Sport or its users.
We may suspend or terminate access where we reasonably believe these Terms have been breached.
9. Fees and Paid Services
Some Keepers Sport services may be free and others may require payment.
Where a fee applies, the price and relevant payment terms will be disclosed before you purchase or activate the relevant service.
Unless otherwise stated, prices are in Australian dollars and include or exclude GST as indicated at the time of purchase.
Any rights you have under the Australian Consumer Law continue to apply.
10. Privacy
Our collection, use and handling of personal information is governed by our Privacy Policy and applicable Australian privacy laws.
By using Keepers Sport, you acknowledge that you have read our Privacy Policy.
11. Availability of Keepers Sport
We aim to provide a reliable service but cannot guarantee that Keepers Sport will always be available, uninterrupted or error-free.
We may change, suspend or discontinue parts of the Services where reasonably necessary for operational, security, legal or commercial reasons.
12. Third-Party Services
Keepers Sport may contain links to or use services provided by third parties.
We are not responsible for third-party websites, services or content and their own terms and privacy policies may apply.
13. Liability
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
To the maximum extent permitted by law, Today’s Tale Pty Ltd is not responsible for loss arising from:
- information or content supplied by users or third parties;
- reliance on historical information that is inaccurate or incomplete;
- interruption or unavailability of the Services;
- unauthorised access outside our reasonable control; or
- third-party websites or services.
Where our liability cannot lawfully be excluded, it will be limited to the extent permitted by law.
14. Your Responsibility
You are responsible for your use of Keepers Sport and for content you provide.
To the extent permitted by law, you are responsible for loss or damage reasonably incurred by us as a direct result of your unlawful use of the Services, your material breach of these Terms, or content you knowingly provide without the necessary rights to do so.
15. Accounts and Termination
You may stop using Keepers Sport at any time.
We may suspend or terminate an account where we reasonably believe:
• these Terms have been materially breached;
• an account is being used unlawfully or improperly;
• suspension is necessary to protect another person, Keepers Sport or its systems; or
• we are required to do so by law.
Where appropriate, we may give you an opportunity to address the issue before terminating an account.
Termination of an account does not necessarily require us to remove historical sporting content that exists independently of that account.
Requests concerning personal information or historical content will be considered in accordance with our Privacy Policy and applicable law.
16. Changes to the Services
Keepers Sport will continue to develop and we may introduce, change or remove features and services from time to time.
These Terms will apply to the Services as they evolve unless separate terms are provided for a particular product or service.
17. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
You submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from those courts.
